| Sidewalk Resolved in Calder's Favor |
| 8/14/2004 9:45:00 PM |
| On Thursday, August 12, the City of Santa Barbara decided that the Calder's could build their sidewalk right at the curbface. They furthermore agreed that the Calder's would not be compelled to build a sidewalk. |
The City's Transportation Planning department has been insisting that the
Planning Commission required us to build a sidewalk as part of our remodeling
project. This has been particularly painful because:
- We volunteered to build one at our expense before we went before the Planning Commission.
- The only reason we went before the planning commission was because one of our neighbors appealed the City's decision to allow us to modify or doors and windows on Santa Anita Road.
Finally the City Attorney intervened and ruled that the Planning Commission did not include a sidewalk requirement in its findings from our case so we are not required to build one.
So now the Transportation Planning department thinks we had a good idea so they will allow us to build a 4-foot wide sidewalk on the Santa Anita Road curb face. Of course they are still able to diddle with us: They are still sitting on our plans. There are still 2 more departments that must review the plans before we can pull the permits. |
